1.3 By using my website, making a booking, or engaging in my support services, you are agreeing to the terms and practices outlined below:​

2.1 I collect personal information that is relevant to delivering my services. This includes:
(i) Your name, date of birth, address, phone number, and email address.
(ii) Overview of your health, diagnosis, developmental, behavioural, or educational history.
(iii) Emergency contacts or key personnel.
(iv) NDIS or funding information (if applicable).
(v) Clinical session notes, reports, and assessments.
2.2 Information is collected via my booking platform (Carepatron), including any documents, intake forms, and session notes. Online sessions may be held via Google Meet, Care Patron, or Zoom, ensuring secure communications are maintained. ​
3. Use of Personal Information
3.1 Your data is used for purposes directly related to the delivery of services, such as:
(i) Scheduling and managing appointments through Carepatron.
(ii) Issuing invoices via InvoiceHome or Carepatron.
(iii) Conducting sessions securely using Google Meet, Carepatron, or Zoom.
(iv) Developing personalised strategies, reports, or support plans.
(v) Communicating with you about your support or relevant service changes.
(vi) Meeting ethical, clinical, and legal requirements.​
4. Storage and Security
4.1 I store personal data securely through:
(i) Password-protected systems.
(ii) Encrypted digital communications.
(iii) Secure platforms (Carepatron, Google Meet, InvoiceHome, Wix).
(iv) Restricted staff access and secure file storage practices.
4.2 When data is no longer required, it is securely de-identified in line with professional and legal obligations.

5. Access and Correction
5.1 You have the right to request access to your personal information and request corrections.
5.2 Requests can be made in writing and may require identity verification.
6. Website Use and Cookies
6.1 My website (hosted via Wix) collects limited non-identifiable information (e.g., browser type, time spent on pages, referring sites) using cookies.
6.2 This helps improve user experience.
6.3 Cookies may be disabled via your browser settings, although this may affect functionality.
7. Confidentiality and Disclosure
7.1 I treat your information with the strictest confidentiality. I only share personal data:
(i) When required or authorised by law.
(ii) When there is a risk of harm to you or others.
(iii) When coordinating care with other professionals (with your consent).​
8. Bookings and Invoicing
8.1 Appointments are made via Carepatron, and invoices are issued through InvoiceHome or Carepatron.
8.2 By booking, you agree to pay the full service fee as outlined in your invoice.
8.3 Services are privately billed and not subject to Medicare bulk billing.
8.4 If you are using NDIS funding, you remain responsible for payment in the event of insufficient or declined funds.
8.5 I will provide approximate costs for support, assessments or documentation requests prior to commencing the work.​
9. Cancellation and Non-Attendance Policy
9.1 A minimum of 48 hours' notice is required to cancel or reschedule appointments.
9.2 Late cancellations or no-shows will incur a 100% cancellation fee.
9.3 For missed appointments, I will attempt to contact you twice within the first 20 minutes before marking the session as a non-attendance.

10. Crisis Support
10.1 Important Note: Shine Through is not a crisis response service.
10.2 If you are in immediate danger or require urgent support, please contact the appropriate emergency services below:
(i) Emergency Services: 000 for police, fire, or ambulance assistance in life-threatening situations.
(ii) Lifeline: 13 11 14 for 24/7 crisis support and suicide prevention services.
(iii) 1800RESPECT – Call 1800 737 732 for national 24/7 support with domestic and family violence or sexual assault.
(iv) NSW Domestic Violence Line – Call 1800 65 64 63 for free, confidential 24/7 support, information, and referrals for people experiencing domestic or family violence in New South Wales.
(v) Your GP or local mental health team.
10.3 I encourage you to inform me if you’ve accessed any crisis support so I can better support you.

11. Intellectual Property
11.1 All content on this website and any materials provided during services or programs (including written content, downloadable resources, and session tools) are the intellectual property of Shine Through.
11.2 You may not copy, reproduce, modify, publish, share, sell, or exploit any part of our website content or materials without written permission. Content is protected under Australian copyright law.
11.3 If you are found to be using any of my content unlawfully, I reserve the right to remove your access to my services or resources and pursue legal action where appropriate.​
12. Complaints About Privacy
12.1 If you have a concern or complaint regarding our privacy practices, please submit your complaint in writing to:

13.3 Continuing to use my services indicates your acceptance of any changes.

14. Governing Law
14.1 This agreement is governed by the laws of New South Wales, Australia, and any disputes shall be resolved in accordance with NSW legal jurisdiction.
14.2 You agree to pay all fees owed under this agreement upon invoice and accept that if any outstanding balance remains unpaid, we reserve the right to pursue recovery, including legal or collection fees incurred in the process.

15. Indemnity
15.1 You agree to indemnify Shine Through from any liabilities, claims, expenses, losses, or damages, including but not limited to personal injury, death, property damage, or rights violations, where such outcomes result directly or indirectly from:
(a) Any violation of the terms laid out in this agreement by you, or
(b) Any breach of the law, negligence, or infringement of the rights of any third party by you, or
(c) Any content submitted by you, or
(d) Any breach or inaccuracy in any representations or warranties made by you to Shine Through.
15.2 You also agree to cover any losses, damages, claims, legal costs, or other expenses that Shine Through may incur as a result of your actions or use of our services. This includes, but is not limited to, breaches of these Terms of Service, breaches of law, submission of content that infringes on third-party rights, or misrepresentations made by you during engagement with our services.
